29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a)MAG Builders, 4588 Quitman, Denver, CO, 80212: On and prior to October 15th, 2014, excavated dirt was placed directly next to the North, West, and East sides of the excavation. The controlling employer in charge of the worksite did not ensure that excavated dirt was placed a minimum of 2 feet from the excavation edge. The condition exposed subcontractor employees installing and removing foundation formwork to struck by hazards associated with falling/rolling dirt and/or rocks into the excavation. MAG Builders was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 810541, citation number 1, item number 2a and was affirmed as a final order on March 28th, 2013, with respect to a workplace located at 4321 Stuart Street, Denver, CO.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a)MAG Builders, 4588 Quitman, Denver, CO 80212: On and prior to October 15th, 2014, the controlling employer did not ensure daily inspections of the excavation were made by a competent person for evidence of a situation that could have resulted in cave-in. The 10 foot deep excavation on the North, East, and West sides were not appropriately sloped, benched or equipped with a support/shield system to prevent cave-in. The condition exposed subcontractor employees installing concrete foundation formwork to struck by hazards associated with cave-in. (b)MAG Builders, 4588 Quitman, Denver, CO 80212: On and prior to October 15th, 2014, the controlling employer did not ensure daily inspections of the excavation were made by a competent person for evidence of a situation that could have resulted in excavated material falling and/or rolling into the excavation. The excavated soil (spoil pile) was placed along the North, West, and East edges of the excavation. The condition exposed subcontractor employees installing concrete foundation formwork to struck by hazards associated with falling/rolling dirt and/or rocks into the excavation.
