29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level nor did an employee signal that it was safe to do so. (a) Lowther Street Bridge over I-83 - An employee operated a CAT D5C XL bull dozer to move crushed rock. The bull dozer did not have an operational back-up alarm on or about January 7, 2013. No abatement certification or documentation required.

29 CFR 1926.651(f): A warning system such as barricades, hand or mechanical signals, or stop logs was not utilized when mobile equipment was operated adjacent to an excavation, when such equipment was required to approach the edge of an excavation, and the operator did not have a clear and direct view of the edge of the excavation (a) Lowther Street Bridge over I-83 - The employer did not ensure that the orange construction barricade fencing was in place at the edge of the excavation for the western abutment. The plastic barricade fencing was lying on the ground in multiple areas surrounding the excavation, a pick-up truck was backed in to within 17 feet of the edge of the excavation, the drop off into the excavation was hidden from view because the grade of the road approaching the excavation was at an incline. This condition was observed on or about January 7, 2013. No abatement certification or documentation required.
