On or about January 8, 2013 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to scaffolding and falls.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    a.  On or about January 8, 2013 - at the above addressed jobsite, employees using a bracket scaffold were not trained to recognize the hazards associated with the use of such scaffold, thereby exposing the employee to the hazards associated with falls.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:    a.  On or about January 8, 2013 - at the above addressed jobsite, employees were working from a bracket scaffold  which did not have the working platform fully planked, thereby exposing the employee to falls.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    a.  On or about January 8, 2013 - at the above addressed jobsite, employees conducting staircase installation from a bracket scaffold approximately fifteen (15) feet six (6) inches and twenty one (21) feet three (3) inches above the ground, were not provided with an access ladder, thereby exposing the employees to falls.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    a.  On or about January 8, 2013 - at the above addressed jobsite, employees performing staircase installation from a bracket  scaffold approximately fifteen (15) feet nine (9) inches and twenty one on (21) feet three (3) inches above the ground, were exposed to injuries from falls due to the lack of fall protection.
