29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section. a. On or about October 08, 2015, at the above addressed jobsite, an employee was conducting grinding operations from a scaffold that was not designed by a qualified person, thereby exposing the employee to the hazards associated with falls.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold: a. On or about October 08, 2015, at the above addressed jobsite, an employee conducting grinding operations from a scaffold, approximately twenty-one (21) feet eight (8) inches above the lower surface, was not protected from falls, thereby exposing the employee to hazards associated with falls. RAUL'S RAILINGS INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(G)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 813621, CITATION NUMBER 1, ITEM NUMBER 4 AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 05, 2013, WITH RESPECT TO A WORKPLACE LOCATED AT 1461 W. AUGUSTA BLVD., CHICAGO, IL.
