The platform only had four planks. An employee of a subcontractor under the supervison of Tekcon Construction Inc., was working from the scaffold approximately 18 feet above grade, observed on or about 1/2/13. (b) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, Pod, and 2nd Floor Deck: The scaffold erected on the 2nd floor deck of the pod was not fully planked. Cross braces were used as a means of access. (a) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, and SW Wing: The access ladder only went up to the second platform, employees of a subcontractor under the supervison of Tekcon Construction Inc. climbed the cross braces and end frames to access the third level of the scaffold system exposing themselves to falls to the ground below up to approximately 20', observed on or about 1/2/13. (b) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, Front of Building Side Entrance was on: The scaffold system was not provided with a ladder; employees of a subcontractor under the supervision of Tekcon Construction Inc. climbed the cross braces and end frames to access the scaffold system exposing themselves to falls to the ground below up to approximately 20', observed on or about 1/2/13. (c) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, SW Pod: A ladder was not provided for employees to use to access the scaffold, employees of a subcontractor under the supervison of Tekcon Construction Inc., climbed the cross braces and end frames when accessing the upper levels exposing themselves to approximate 4' fallls to the ground below, observed on or about 1/2/13. (d) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, Front of Building Side Entrance was on: The scaffold system was not provided with a ladder employees of a subcontractor under the supervison of Tekcon Construction Inc., climbed the cross braces and end frames to access the scaffold system exposing themselves to falls to the ground below up to approximately 20', observed on or about 1/3/13. (e) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, and SW Wing: The access ladder only went up to the second platform, employees of a subcontractor under the supervison of Tekcon Construction Inc., climbed the cross braces and end frames to access the third level of the scaffold system exposing themselves to falls to the ground below up to approximately 20', observed on or about 1/5/13. (f) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, POD Back Deck: A ladder was not provided for employees to use to access the side bracket or the top level of the scaffold, employees of a subcontractor under the supervison of Tekcon Construction Inc., climbed the cross braces and end frames to access the uupper levels exposing themselves up to approximately 20' falls to the ground below, observed on or about 1/31/13. (g) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, Exterior Pool Room Wall: The ladder was only elevated to the 1st level of the scaffold system. Employees of a subcontractor under the supervison of Tekcon Construction Inc., were working on the second and third levels of the scaffold system and used the cross braces to access those levels exposing themselves to falls to the ground below up to approximately 20', observed on or about 2/22/13. (b) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees: An employee of a subcontractor under the supervison of Tekcon Construction Inc., was working on the 4th level of the scaffold system without the use of guard rails, approximatley 26 feet above grade, observed on or about 1/5/13. (c) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, Pod Deck: Employees of a subcontractor under the supervison of Tekcon Construction Inc., were working on a scaffold positioned on the edge of the back deck without the use of end-rails, approximatley 16 feet above grade, observed on or about 1/31/13. (d) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, Exterior Wall of the Pool Room: Employees of a subcontractor under the supervison of Tekcon Construction Inc., were working on the side bracket of the scaffold system that was not provided with end-rails, approximatley 13 feet above grade, observed on or about 2/22/13. (e) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, SW Wing: When cross bracing was used in lieu of a top-rail a mid-rail was not provided. Employees of a subcontractor under the supervison of Tekcon Construction Inc., were observed working on the second and third levels of the scaffold system without a mid-rail in place, approximate heights ranging from 13 to 19 feet 6 inches in height above the ground, observed on or about 1/2/13. (f) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, SW Wing: When cross bracing was used in lieu of a top-rail a mid-rail was not provided. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). 29 CFR 1926.1053(b)(21): Employees were not grasping the ladder with at least one hand when progressing up and/or down the ladder: (a) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, Exterior Pool Room Wall: Two employees of a subcontractor, under the supervison of Tekcon Construction Inc., were exposed to fall hazards when they were observed descending the ladder with equipment in their hands and unable to maintain at least 3 points of contact, observed on or about 2/22/13. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
