29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:     a)    Construction site, 1031 Voorhees Drive, Voorhees, NJ - Employer's representatives did not recognize unsafe conditions in plain view on their site such as: lack of fall protection for employees of the subcontractor working from scaffolding at heights greater than 10 feet, uncapped reinforcing steel, lack of guarding for the homemade table saw, electrical cords pinched by closed doors, missing ground prongs on extension cords, unprotected floor holes, fire extinguishers available for use missing safety seals for the locking pins and missing locking pins, homemade extension cords with 4x4 utility boxes, and power tools with damaged wiring, on or about 05/10/13.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)    1031 Voorhees Drive, Voorhees, NJ; west side, north end of building - Employee of subcontractor without proper fall protection was working at the end of the mason's platform approximately 13 foot 2 inches above ground level on an approximately 46 feet high x 112 feet long x 7 feet deep fabricated frame scaffold, on or about 05/10/13;    b)   1031 Voorhees Drive, Voorhees, NJ; west side, north end of building - Employee of subcontractor without proper fall protection was working at the end of the mason's platform approximately 19 foot 9 inches above ground level on an approximately 46 feet high x 112 feet long x 7 feet deep fabricated frame scaffold, on or about 05/10/13;    c)    1031 Voorhees Drive, Voorhees, NJ; west side, south end of scaffold - Employee of subcontractor without proper fall protection was working at the end of the mason's platform approximately 26 foot 4 inches above ground level on an approximately 46 feet high x 112 feet long x 7 feet deep fabricated frame scaffold, on or about 05/10/13.        NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:    a)    1031 Voorhees Drive, Voorhees, NJ; west side of building - Employer's representative did not recognized basic unsafe conditions in the setup of the fabricated frame scaffold used on site by the subcontractor (no fall protection or improper fall protection by employees working on the scaffold, unsafe means of access for upper levels of scaffold, inadequate overlap of platform planks - less than 6 inches, spacing between planks greater than 1 inch), on or about 05/10/13.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
