OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught between hazards while operating a 230 ton Pacific hydraulic press brake to bend material:    a) Shop Area; On January 10, 2013 and at times prior employees were exposed to caught between hazards while operating a press brake with a metal vise grip being used as the mode selector between off, inch, single stroke manual return, single stroke auto return on the equipment.  This mode selector is not controlled or under supervisor direction.

The employer failed to provide a foot pedal for the second operator, or helper, while operating the machine.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    a) Storage and Shop Area; On or about January 10, 2013 and at times prior the employer exposed his employees to struck by hazards in that employees were allowed to operate a powered industrial truck without the employer first ensuring the employee was competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified in the regulation.

The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    a)Shop area; On or about January 10, 2013 and at times prior thereto the employer exposed employees to point of operation hazards in that employees were allowed to operate the Pacific 230 ton hydraulic press brake where the point of operation was not guarded by such as but not limited to barrier guards, two-hand tripping devices, or other electronic safety devices.
