29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. a. On or about January 16, 2013 - at the above addressed jobsite, an employee working in a GENIE Ss-40 telescopic boom aerial lift was not attached to the boom or basket by the use of a lanyard, thereby exposing the employee to the hazards associated with a fall of more than fifteen (15) feet. b. On or about January 16, 2013 - at the above addressed jobsite, an employee working in a JLG 400S telescopic boom aerial lift was not attached to the boom or basket by the use of a lanyard, thereby exposing the employee to the hazards associated with a fall of more than fifteen (15) feet.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a. On or about January 16, 2013 - at the above addressed jobsite, employees were lifting large steel members using lifting straps placed around the mast/forks of a JLG SKYTREK 6042 Rough Terrain Forklift. This practice could affect the capacity of the equipment and the manufacturers written approval was not obtained, thereby exposing the employees to a struck by hazards due to forklift tip over.
