29 CFR 1915.71(j)(1): Scaffolding, staging, runways, or working platforms which are supported or suspended more than 5 feet above a solid surface, or at any distance above water, were not provided with a railing, which had a top rail whose upper surface was from 42 to 45 inches. M/V Malaspina - (a) On or about the 8th of January 2013, an employee was observed working in the valve thruster area, and was exposed to falls greater than 12 feet through an unprotected scaffold platform opening of 21" X 39".

29 CFR 1915.71(j)(5): Toe boards of at least 1 x 4 inch lumber were not provided when they were necessary to prevent tools and materials from falling on men below. M/V Malaspina- (a) On or about January 8th 2013, employees working in the #2 void were exposed to materials falling 18 feet through an 18" X 108" deck opening, which was not guarded with toe boards.
