OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a flash fire hazard because combustible dust was allowed to accumulate in, around and under a wide-belt sanding machine:   (a) On or about January 2, 2013, a Steinemann wide-belt Sato sanding machine's dust collection system was modified to increase the number of dust collection inlet pickup points within the sander without a redesign or evaluation to insure that adequate vacuum suction remained to prevent accumulation of hazardous amounts of combustible dust within the sander.  Accumulations of combustible dust, after the modification, posed a flash fire hazard to sanding machine operators.

29 CFR 1910.22(a)(2): The floor of every workroom shall be maintained in a clean and, so far as possible, a dry condition:     (a) On or about January 2, 2013, the area under and around a Steinemann wide-belt Satos sanding machine contained combustible wood dust in depths that exceeded 1/8 inch. The excessive accumulation of wood dust observed on the floor resulted from dust not being captured and conveyed to a safe location by the sander's dust collection system and residual dust that was blown from the sanding machine during and after shift cleaning.
