29 CFR 1926.451(g)(4): Guardrail systems installed to meet the requirements of this section shall comply with the following provisions (guardrail systems built in accordance with Appendix A to this subpart will be deemed to meet the requirements of paragraphs (g)(4)(vii), (viii), and (ix) of this section): At the jobsite located at 101 S. Rock Rd., Derby KS: Employees engaged in residential construction activities using the job made wooden walkway were exposed to fall hazards of approximately 11 feet from the walking surface to the ground below in that the walkway was not equipped with a mid-rail.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. At the jobsite located at 101 S. Rock Rd., Derby KS: Employees engaged in residential construction activities from a 4:12 pitch roof were exposed to fall hazards of approximately 18 feet to the ground below in that fall protection was not used.

29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed. At the jobsite located at 101 S. Rock Rd., Derby KS: Employees engaged in residential re-roofing activities using a Werner MT-22 multi-use telescoping ladder were exposed to ladder collapse and fall hazards in that the top rung of the ladder was used as a step when set up in the A-frame ladder configuration which is not in accordance with the manufacturer's recommendations.
