29 CFR 1910.147(c)(6)(i):     The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:    The employer failed to protect employees from potential caught between and electrical hazards associated with using written specific procedures for Lockout and Tag out that have not been reviewed within the past year.  This was most recently evident during the inspection of the facility located at 900 Kelly Ryan Drive, Blair, NE 68008, where the employer has employees conducting maintenance on equipment throughout the facility while using written specific procedures that have not been reviewed in over a year.  Instances include but are not limited to:      i.  The S4 Accur Shear located in the east building, steel room; written procedure made and last reviewed December 1, 2007.  The machine is locked out weekly for maintenance.    ii. The paint booth located in the south building, paint department; written procedure made and last reviewed 2007.  The paint room is locked out weekly for maintenance.

This was most recently evident during the inspection of the facility located at 900 Kelly Ryan Drive, Blair, NE 68008, where the employer has employees using equipment with inadequate guarding in the fabrication of farm implements.  Instances include but are not limited to:    i.  In the welding shop there are employees using the Fabbrica Machine Berganmo horizontal band saw to cut metal used in the fabrication of farm implements without having guarded the blade to the left side of the cutting area.    ii. In the welding shop there are employees using the Delta Mfg Co. Drill press in the metal fabrication of farm implements without guarding the point of operation.

This was most recently evident during the inspection of the facility located at 900 Kelly Ryan Drive, Blair, NE 68008, where the employer has employees turning on lights and using equipment where the employer is providing power by using a temporary cord in lieu of permanent wiring.  Instances include but are not limited to:      i.  A yellow flexible cord plugged into an outlet on one side of a wall, then ran through a hole in the wall without having a grommet to protect it against rubbing, along the floor and across a walk way in the room next door where it is providing consistent power to a horizontal band saw.    ii. A yellow flexible cord plugged into an outlet next to the doorway between the shop and the storage area, ran through the doorway behind the open door exposing it to a potential pinch point, along the storage racks exposing it to damage as product is placed on the racks and then providing the only power to a fluorescent light.

29 CFR 1904.7(b)(3):     The employer did not correctly classify the following work-related injuries or illnesses on the OSHA Form 300 or equivalent.     The employer failed to update and maintain accurate injury and illness logs in accordance with this subpart.  This was most recently evident during the inspection of the facility located at 900 Kelly Ryan Drive, Blair, NE 68008, where the employer has employees that missed days of work or were unavailable to work and the employer has not accurately recorded that on the companys injury and illness logs.  Instances include but are not limited to:      i.  On 5/18/12 an employee received a laceration to the cornea and didnt return to work until 5/29/12.  The employee received first aid from the employer and was taken to the emergency room.  This was recorded on the 300 log as other recordable case and no loss time.
