29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) East Side of Building - On or aboout January 23, 2013 an employee was exposed to fall hazards while working at the edge of concrete shoring 12 feet above the ground. Employee was not protected from falling to a lower level by guardrail systems, safety net systems or personal fall arrest systems. (b) Perimeter of Comfort Station, Upper Level - On or about February 1, 2013 employees were exposed to fall hazards while working on an upper level 12 feet 5 inches above the ground. Employees were not protected from falling to lower level by guardrail system, safety net system or personal fall arrest systems.

29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigied support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) North Side of Comfort Station - On or about February 1, 2013 employees were exposed to fall hazards while using a ladder to access an upper level. Employees were not protected by the ladder extending 3 feet beyond the landing or having a grasping device available to assist in mounting or dismounting the ladder.
