ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a)    On or about January 24, 2013, and times prior thereto, at the Zaxbys jobsite in Savannah, the employer failed to ensure that an employee engaged in laying tar paper and other substrates on two towers surfaces had conventional fall protection while at or near unprotected edges, exposing the employee to fall hazards of 21 ft. 1 in. to the ground.  Wormley Brothers Enterprises, Inc. was previously cited for a violation of this OSHA standard 29 CFR 1926.501(b)(1), contained in OSHA inspection 309624203, Citation 1, Item 1, a jobsite located at 7341 Spout Spring Rd., Flowery Branch, GA, issued on 5-25-2007, FOD 6-15-2007; AND was previously cited for a violation of the same OSHA standard 29 CFR 1926.501(b)(1), contained in inspection 312531601, Citation 1, Item 1, a Racetrac jobsite located at 1385 Grayson Hwy., Lawrenceville, GA, issued on 3-22-2010, and FOD on 4-12-2010.
