29 CFR 1910.119(e)(5): The employer did not establish a system (for Process Hazard Analysis) to promptly address the team's findings and recommendations; assure that the recommendations are resolved in a timely manner; and that the resolution is documented. (a) Chlorine Unloading and Vaporization, on or about January 14-18, 2013, and at times prior thereto, the employer did not document findings and recommendations in an action list for the PHA Re-validation conducted on December 2008 - February 2009. A 2009 Chlorine Unloading PHA Revalidation action list was NOT included in the documentation provided at the time of the inspection. (b) Lurgi Plants (134 & 234), on or about January 14-18, 2013, and at times prior thereto, the employer did not adequately document findings and recommendations in an action list for the PHA Re-validation conducted on November 27-28, 2012. The 2012 Lurgi PHA Revalidation Follow-up Items document did not include all the hazards that were identified, including , but not limited to: (1) FACILITY/STATIONARY SOURCE SITING CHECKLIST; Section IV; Location and Construction of the Control Rooms, Item #11. There was no action item to review of entry points and check for sealing to ensure chlorine gas could not enter the rooms. (2) FACILITY/STATIONARY SOURCE SITING CHECKLIST; Section VI, Location of Engineering, Lab, Administrative, or Other Buildings, Item #3. There were no recommendations or action items for the potential for vapor cloud under unfavorable conditions. (3) HUMAN FACTORS CHECKLIST; Section III; Labeling, Items 1-3. Labels, labeling program, and updating labels referred to Safety Audit Process and lockout revisions. No action items were documented for these checklist items.
