Section (5)(a)(1) of Public Law 91-596, the Occupational Safety & Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that:  employees were exposed to the hazard of being struck by a new metal sign being suspended above them by a sling from the forks of a Terex Telehandler Lift, whose forks had holes cut/bored through the forks, thereby weakening their lifting capacity.    (a) Word of Life Mission Outreach Center, 1133 West Capitol Street, Jackson, MS 39203 - On or about 1/25/2013 at 1:55 PM employees were exposed to a 500 pound metal sign falling, as it was being installed at the above address, because holes had been cut/bored through the ends of both forks attached to the Terex TX 55-19 Compact Telehandler lift to allow two 2 inch diameter trailer-hitch balls to be mounted to keep the fabric sling from slipping off the weakened fork ends.

29 CFR 1926.200(g)(1):   Construction areas shall be posted with legible traffic signs at points of hazard.    (a) Word of Life Mission Outreach Center, 1133 West Capitol Street, Jackson, MS 39203 - On or about 1/25/2013 at 1:55 PM employee(s) were exposed to being struck by traffic vehicles, moving in one or both east-bound lanes of West Capitol Street, due to this employer's use of a Terex TX 55-19 Industrial Forklift to lift a new metal sign into place while blocking the southern-most east-bound traffic lane.  No flagman was present, nor were any traffic control devices present, to alert and divert motorists on their approach to the work zone where the forklift was sitting in the southern-most lane at the intersection of Rose Street with Capitol Street.

29 CFR 1926.303(b)(1):     Grinding machines shall be equipped with safety guards in conformance with the requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels, and paragraph (d) of this section.    (a) Word of Life Mission Outreach Center, 1133 West Capitol Street, Jackson, MS 39203 - On or about 1/25/2013 at 1:55 PM employee(s) were exposed to abrasions and avulsions from a 4 1/2 inch diameter DeWalt Model D28402 right-angle grinder, S/N 663421, due to the absence of its 180 degree guard while it was being used to smooth welds during the installation of a new metal sign atop the building's awning, located above the city sidewalk.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    (a) Word of Life Mission Outreach Center, 1133 West Capitol Street, Jackson, MS 39203 -  On or about 1/25/2013 at 1:55 PM employee(s) were exposed to falling 9.8 feet while working atop a building awning located above a sidewalk without fall protection, i.e., a welder was observed welding brackets for a new metal sign atop the awning while the open ends were not guarded, nor was the employee wearing personal fall arrest equipment.

29 CFR 1926.1053(b)(1):     When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab-rail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.
