Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck and crushed by a bell annalear furnace positioned on a support stand:      At this establishment, on or about December 26, 2012, and at times thereafter in the wire mill area, a bell annealer industrial furnace, weighing approximately 1 ton was placed on a shop-made stand.  The shop-made stand was observed in the following condition:    a. The overhead crane hoist line was no longer attached to stabilize the bell annealer; the entire weight of the bell annealer rested on the shop-made stand.     b. The square frame support stand was not bolted to the foundation in order to prevent any movement in the event it was struck by a fork lift truck or other equipment.    c. The area around the square frame support stand was not protected by barriers to prevent equipment such as, but not limited to, scissor lifts and fork lift trucks, from operating in close proximity to the floor stand on which the bell annealer was positioned.

29 CFR 1910.178(q)(6):  Industrial trucks were altered by the addition of extra parts not provided by the manufacturer or elimination of parts provided by the manufacturer:  At this establishment, forklift truck boom lift extensions were not pinned to the forks to prevent them from sliding off of the lift truck forks during use.  Employees were exposed to being struck by materials falling from the lifts.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:    At this facility, the employer did not develop, document or utilize procedures for controlling hazardous energy.  Employees performing servicing and maintenance activities were exposed to electrical shock, burns, and other injuries.  Among other equipment the employer has multiple cure presses of various lengths which have multiple sources of energy such as hydraulic, electric, pneumatic, and thermal energy.    National Electric Coil Co., L.P., was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 315178525, citation number 1, item number 4 and was affirmed as a final order on May 26, 2011, with respect to a workplace located at 3330 E 14th St, Brownsville, TX.
