29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) (a) Location: San Carlos Indian Reservation,Tulapai Flats Subdivision, San Carlos, AZ: On or about January 29, 2013 and at times prior thereto, the Project Superintendent and the Site Superintendent failed to ensure that fall protection was provided for employees engaged in residential construction activities six (6) feet or more above lower levels. Employees of the framing subcontractor erected trusses and applied sheeting to roofs of newly constructed houses, eave heights of 8 feet 5 inches from the ground level, and were not provided fall protection. The framing subcontractor had been onsite approximately one(1) month and had not implemented a fall protection program during that time.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Location: San Carlos Indian Reservation, Tulapai Flats Subdivision, San Carlos, AZ: On or about January 29, 2013 and at time prior therto, the employer, as the controlling employer on site, did not ensure that framing subcontract workers performing residential roof work at heights above 8 feet 5 inches were protected by fall protection, exposing them to fall hazards.
