29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Location: Tulapai Flats Subdivision, San Carlos, AZ: On or about 29 Jan 2013, the Project Superintendent, Site Superintendent, and the Foreman failed to ensure that: (1) re-bars were capped in and about a foundation formwork for a planned single family residence (house #16) while three employees were performing earth-leveling work on uneven surfaces prior to the concrete pour, and that (2) portable fire extinguishers brought onsite by sub-contractors did not meet the certification and maintenance requirements for use, and that (3) a powered industrial vehicle (Gradall 534B Material Handler used as a rough terrain forklift) was operated by an uncertified and un-evaluated operator for that particular piece of machinery, thereby exposing employees to hazards.
