29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) Location: Tulapai Flats Subdivision, San Carlos, AZ: On or about 29 Jan 2013, the Project Superintendent, Site Superintendent,  and the Foreman failed to ensure that:   (1) re-bars were capped in and about a foundation formwork for a planned single family residence (house #16) while three employees were performing earth-leveling work on uneven surfaces prior to the concrete pour, and that  (2) portable fire extinguishers brought onsite by sub-contractors did not meet the certification and maintenance requirements for use, and that  (3) a powered industrial vehicle (Gradall 534B Material Handler used as a rough terrain forklift) was operated by an uncertified and un-evaluated operator for that particular piece of machinery,  thereby exposing employees to hazards.

29 CFR 1926.150(c)(1)(i): A fire extinguisher, rated not less than 2A, was not provided for each 3,000 square feet of the protected building area, or major fraction thereof:  (a) Location: Tulapai Flats Subdivision, San Carlos, AZ: On or about 29 Jan 2013, and at times prior thereto, the employer, as the General Contractor and Controlling Employer, did not ensure that a portable fire extinguisher was provided in each of the protected building areas of the newly erected seven single family residences where sub-contractors were still performing work, exposing employees to hazards.

No. 10A-1970:  (a) Location: Tulapai Flats Subdivision, San Cartlos, AZ: On or about 29 Jan 2013, and at times prior thereto, the employer, as the General Contractor and Controlling Employer, did not ensure that two portable fire extinguishers, owned by and brought onsite by a sub-contractor, were inspected and maintained annually and monthly, exposing employees to hazards.

29 CFR 1926.701(b):  All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:  (a) Location: Tulapai Flats Subdivision, San Carlos, AZ:  On or about 30 Jan 2013, and at times prior thereto, the employer did not ensure that re-bars were capped when employees worked in direct proximity while preparing the foundation surface within the framework for the planned concrete pad of a new build single family residence, exposing the employees to impalement hazards.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l),:  (a) Location: Tulapai Flats Subdivision, San Carlos, AZ: On or about 29 Jan 2013, and at times prior thereto, the employer allowed a sub-contractor to operate the company-owned Gradall 534B telescopic material handler (configured for use as a rough terrain forklift), without certifiyng that the operator had been trained and evaluated on that particular machinery prior to use, exposing the operator and other employees to hazards.   Note:  As set forth at 29 CFR 1910.178(l)(6) and as referenced and incorporated by the note contained in 29 CFR 1926.602(d).
