29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    At Bay 4, Crane 1, Loading Dock, a shipping dock employee was exposed to a 53" fall hazard while working on the edge of the open-sided bed while removing steel tubing bundles on a flatbed trailer.  On or about January 11, 2013, Bay 4, Crane 1, Loading Dock, a shipping dock employee fell off the open-sided flatbed trailer while removing 11 steel tubing bundles weighing 1,800 lbs. each from the bed of a flatbed trailer, using a five ton overhead top running double girder crane and synthetic web nylon slings without utilizing any form for of fall protection.

29 CFR 1910.136(a):     General requirements. The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, and where such employee's feet are exposed to electrical hazards.     On or about January 11, 2013,  at Bay 4, Loading Dock, a Shipping employee was exposed to a crushing hazard by not wearing metatarsal steel-toed shoes while unloading 11 steel tubing bundles weighing approximately 1,800 lbs. each off the bed of the flatbed trailer by using a five ton overhead top running double girder crane and synthetic web nylon slings.

29 CFR 1910.179(f)(2)(iii): Holding brakes on hoists shall be applied automatically when power is removed.    On or about January 11, 2013, at Bay 4, Loading Dock Area, a shipping dock employee was removing 11 steel tubing bundles, weighing approximately 1,800 lbs. each from the flatbed trailer using a five ton top running double girder crane and continuous synthetic nylon web slings and in the course of lowering the load using the remote control the employee removed his finger off the power to the hoist and the load continued moving downward, pinning his right foot under the load and then causing him to fall off the flatbed trailer and to the ground.

29 CFR 1910.179(j)(3):   Periodic inspection. Complete inspections of the crane shall be performed at intervals as generally defined in paragraph (j)(1)(ii)(b) of this section, depending upon its activity, severity of service, and environment, or as specifically indicated below. These inspections shall include the requirements of paragraph (j)(2) of this section and in addition, the following items. Any deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard:  The periodic inspection interval of Crane 1, Bay 4, Loading Dock, a five ton overhead top running double girder crane, currently yearly, was not adequate based on the failure of the brake hoist motor to stop the movement of the hoist when removing power, the high daily usage rate of this crane, lifting loads weighing several thousand pounds, and the inadequate training provided to crane operators on how to properly inspect the crane before its use.

29 CFR 1910.184(i)(1):   Sling identification. Each sling shall be marked or coded to show the rated capacities for each type of hitch and type of synthetic web material.  On or about January 11, 2013, at Bay 4, Loading Dock, a shipping clerk employee was using a four foot continuous synthetic web nylon sling with a tag which was illegible while unloading 11 steel tubing bundles with a five ton top running double girder crane.
