OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from falls and/or crushing: On or 23 November 2016, the employer regularly used powered industrial trucks to lift employees on a custom elevating platform that was not provided with a means of attachment to prevent the platform from displacement, sliding or otherwise falling off of the forks. Employees were directed to perform work from the elevated platforms while at heights of up to 23 feet. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides. On or about 23 November 2016, employees retrieving materials from racking systems up to 23 feet above grade were not provided with fall protection by a standard guardrail system or equivalent means while working from platforms supported by "Order Picker" powered industrial trucks. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

On or about 23 November 2016, the employer allowed the employees in powered industrial trucks to travel through the warehouse and work area with elevated loads of material. Employees in the area beneath elevated loads were exposed to struck-by hazards from falling material and/or crushed-by lowering equipment structure. 29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about 23 November 2016, the employer failed to ensure that all powered industrial trucks were properly inspected and removed from service if any safety conditions were found. On the Combilift side loaders, the protective screens to protect operators from struck-by hazards was missing on all observed vehicles. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.213(h)(1): The upper hood shall completely enclose the upper portion of the blade down to a point that will include the end of the saw arbor. The upper hood shall be constructed in such a manner and of such material that it will protect the operator from flying splinters, broken saw teeth, etc., and will deflect sawdust away from the operator. The sides of the lower exposed portion of the blade shall be guarded to the full diameter of the blade by a device that will automatically adjust itself to the thickness of the stock and remain in contact with stock being cut to give maximum protection possible for the operation being performed: On or about 23 November 2016, the lower exposed portion of the circular saw blade on the radial arm saw was not guarded to the full diameter of the blade by a device that automatically adjusted itself to the thickness of the stock and the guard did not remain in contact with the material being cut. This exposed employees to contact with the rotating blade. Abatement is not required for this item.
