29 CFR 1926.416(a)(2): In work areas where the exact location of underground electric power lines was unknown, employees using jackhammers, bars, or other hand tools which may contact a line were not provided with insulated protective gloves:   On or about January 29, 2013, an employee was exposed to electric hazards when the employee was using work gloves instead of insulated gloves when he used hand tools (shovels) to locate de-energized underground power cables in an area where energized power cables were located.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit.    On or about January 29, 2013, an employee was exposed to electrical hazards when an employee cut into an energized underground power cable with a saw while trying to remove de-energized underground power cables (scrap cables) out of the way of the new driveway.

29 CFR 1926.651(b)(2):     Utility companies or owners were not contacted within established or customary local response times, advised of the proposed work, and asked to establish the location of the utility underground installations prior to the start of an(a)(LOCATION)(IDENTIFY SPECIFIC OPERATIONS AND/OR CONDITIONS)(DESCRIBE HAZARD(S) WHERE NECESSARY)    On or about January 29, 2013, an employee was exposed to electrical hazards when an employee cut into an energized underground power cable with a saw while trying to remove de-energized underground power cables (scrap cables) out of the way of the new driveway.  The employer failed to contact the utility company and/or owners to establish the location of the underground utilities.

29 CFR 1910.1200(h)(3)(iv): Employee training did not include the details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information: (Construction Reference: 1926.59)    On or about January 29, 2013, employees were exposed to chemical hazards when the employer did not provide effective employee training.  Employees had not heard of Material Safety Data Sheets, did not know where to find them at the construction site, and did not remember ever receiving instruction concerning the use of the sheets.  Employees were exposed to chemicals such as, but not limited to, gasoline, diesel, pipe glue, and spray paint.
