29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes by covers: (a) Apex Construction Management, Inc., 2426 Lafayette Street, Denver, CO: On and prior to January 23, 2013, the employer created a hazard to which employees of another contractor were exposed to after removing sections of sub-flooring in the living room on the first floor. Condition exposed employees to trip and/or fall hazards up to 16 inches deep. (b) Apex Construction Management, Inc., 2426 Lafayette Street, Denver, CO: On and prior to January 23, 2013, the employer created a hazard to which employees of another contractor were exposed to after removing sections of sub-flooring in the dining room on the first floor. Condition exposed employees to trip and/or fall hazards up to 16 inches deep. (c) Apex Construction Management, Inc., 2426 Lafayette Street, Denver, CO: On and prior to January 23rd, 2013, the employer created a hazard to which employees of another contractor were exposed to after removing existing stairs in the kitchen area between the first floor and basement. Condition exposed employees to a 7 foot fall hazard through a floor hole measuring 30 inches wide by 12 feet long.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Apex Construction Management, Inc., 2426 Lafayette Street, Denver, CO: The employer had not developed and implemented an effective fall hazard training program to ensure fall hazards were identified and eliminated prior to employees of other contractors beginning work. On and prior to January 23, 2013, this condition exposed employees of another contractor to fall hazards up to 7'-3".
