29 CFR 1926.1101(k)(3)(i): Before work in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM) was begun, the employer did not identify the presence, location, and quantity of ACM and/or PACM, pursuant to paragraph (k)(1) of this section: Apex Construction Management Inc, at 2426 Lafayette Street, Denver, CO: On or about 1/3/13, before work in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM) was begun, Apex Construction Management Inc did not identify the presence, location, and quantity of ACM and/or PACM, pursuant to paragraph (k)(1) of this section. An employee of Apex Construction Management Inc performed demolition activities, including removal of plaster lath walls. The walls were covered with surface texturing. The home was built and remodeled prior to 1980. Surface texturing is Presumed Asbestos Containing Material (PACM). The employer did not identify the presence, location, and quantity of PACM prior to work beginnning. This condition potentially exposed the employee to an asbestos hazard.

29 CFR 1926.1101(k)(9)(vi): Training for employees performing Class IV operations was not consistent with EPA requirements for training of local education agency maintenance and custodial staff as set forth at 40 CFR 763.92(a)(1): Apex Construction Management Inc, at 2426 Lafayette Street, Denver, CO: On or about 1/3/13, Apex Construction Management Inc did not ensure that training for employees performing Class IV operations was consistent with EPA requirements for training of local education agency maintenance and custodial staff as set forth at 40 CFR 763.92(a)(1). An employee of Apex Construction Management Inc performed demolition activities, including removal of plaster lath walls. The walls were covered with surface texturing.
