29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:     29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) The employer did not train and evaluate employees operating the Lull 644E-42 all terrain forklift. 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:     a)  Employees engaged in masonry work were not protected from the hazards of falling approximately 30 feet to the ground, while working along unprotected edges of the balcony deck.      The Profus Construction Corp., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 312592058, citation number 1, item number 3 and was affirmed as a final order on April 7, 2009, with respect to a workplace located at 1254 W. Jackson Blvd, Chicago, IL 60607.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1052(c)(1)(i):  Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:    a)  Employees were exposed to the hazard of falling while using stairways that were not equipped with a stairrail system.    The Profus Construction Corp., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1052(c)(1)(i), which was contained in OSHA inspection number 312592058, citation number 1, item number 2b and was affirmed as a final order on April 7, 2009, with respect to a workplace located at 1254 W. Jackson Blvd, Chicago, IL 60607.    No abatement certification or documentation is required for this item.
