29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site pursuant to paragraph (k)(1) of this section: Cypress Investments LLC, at 2426 Lafayette Street, Denver, CO: On or about 1/17/13, before work subject to this standard began, Cypress Investments LLC did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site pursuant to paragraph (k)(1) of this section. Cypress Investments LLC owned the property. Cypress Investments LLC hired Apex Construction Management Inc to perform structural repairs and modifications that involved removal of plaster lath walls. Cypress Investments LLC hired Rhein-O Demolition to perform demolition activities, including removal of plaster lath and drywall walls. The walls were covered with surface texturing. The home was built and remodeled prior to 1980. Surface texturing is Presumed Asbestos Containing Material (PACM). The building owner did not identify the presence, location, and quantity of PACM prior to work beginnning. This condition potentially exposed employees of Rhein-O Demolition and Apex Construction Management Inc to an asbestos hazard.
