29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) Near HWY 82 Hinesville GA - On or about, and at times prior to January 30, 2013, employees were allowed to work in trench with miscellaneous tools, water pipes, and spoil piles that were less than 2 feet of the open trench, thus exposing employees to cave-in and struck-by hazards.

29 CFR 1926.651(c): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a) Trench activity adjacent Hwy 82, Hinesville, GA - On or about January 30, 2013, employees were allowed to work inside a trench that was over 37 feet long and greater than 4 feet deep without a safe means of egress such as a ladder, thus exposing employees to delay in egress hazard. The Tyson Utilities Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652 (c) (2), which was contained in OSHA inspection number 310991856, citation 1, item number 2 and was affirmed as final order July 5, 2009, with respect to workplace located at Hwy 21 South, Between Mile Markers 7 & 8 Rincon, GA 31326.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) Adjacent Highway 82, Hinesville GA - On or about January 30, 2013, the foreman along with employees accessed and performed work in a 8-foot deep trench without cave-in protection, thus exposing the employees to struck-by, and cave-in hazards. b) Adjacent Highway 82, Hinesville GA - On or about January 30, 2013, employees accessed and performed work in a 5-foot to 7-foot deep trench without cave-in protection, thus exposing the employees to struck-by, and cave-in hazards. The Tyson Utilities Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652 (a) (1), which was contained in OSHA inspection number 310993407, citation 1, item number 1 and was affirmed as final order November 18, 2009, with respect to workplace located at 205 Waters Drive, Vidalia, GA 30474. ABATEMENT CERTIFICATION IS NOT REQUIRED
