29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.   At the intersection of Highway 146, on February 1, 2013, employees were installing an over head traffic pole from an Altec Derrick Digger Truck and the operators seat belt was damaged and unusable, leaving the operator exposed to falls from heights.

29 CFR 1926.251(a)(6): Each day before being used, and during use, where service conditions warrant, the sling and all fastenings and attachments were not inspected for damage or defects by a competent person, and damaged or defective slings were not immediately removed from service:  At the intersection of Highway 146, on February 1, 2013, employees were installing an over head traffic pole from using a synthetic sling that was not inspected and had visible damage, exposing employees to struck by hazards.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated   At the intersection of Highway 146, on February 1, 2013, employees were installing an over head traffic pole from an aerial lift and was not wearing fall protection while in the lift, exposing the employee to falls from heights.

At the intersection of Highway 146, on February 1, 2013, employees were installing an over head traffic pole from an Altec Digger Derrick truck and the trucks crane annual inspection expired on November 8, 2012, exposing employee to possible mechanical failures.
