29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Location: Tulapai Flats Subdivision, San Carlos, AZ: On or about 29 Jan 2013, and at times prior thereto, an employee was standing atop a wooden saw horse (32 inches from the ground level) while using a pneumatic-powered nail gun under the eaves of a newly-built single family residence, in plain view of the Foreman and other employees, exposing the employees to hazards.

No. 10A-1970: (a) Location: Tulapai Flats Subdivision,San Carlos, AZ: On or about 29 Jan 2013, the employer did not ensure that the portable fire extinguishers which it brought onsite and placed within 50 feet of flammable fuel used for re-fueling their portable generators were inspected annually and monthly, exposing employees to hazards.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l)(4)(ii)(D): (a) Location: Tulapai Flats Subdivision, San Carlos, AZ: On or about 29 Jan 2013, and at times prior thereto, the employer failed to provide refresher training and evaluate and certify the operator of a rough terrain forklift prior to use, exposing the employees to hazards. Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178 AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d).
