29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.    The employer failed to conduct annual periodic reviews of the written specific procedures used as part of the companys lockout and tag out program.  This was most recently evident during the inspection of the facility located at 404 West 8th Street, Kearney, NE 68845, where the employer has employees using written specific procedures as part of the companys written lockout and tag out program while they are operating and maintaining equipment and those procedures have not been formally reviewed within the past year as outlined in this subpart.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    The employer failed to protect employees from potential amputation associated with operating machines with inadequate or missing guards.  This was most recently evident during the inspection of the facility located at 404 West 8th Street, Kearney, NE 68845, where the employer has employees operating several pieces of equipment that lack effective guarding.  Instances include but are not limited to:        i.  On the production floor employees are using the Ellis horizontal band saw (model and serial numbers unknown due to a missing data plate) in the fabrication of parts and equipment where there is 9 of unguarded blade to the left side of the cutting area.  ii. On the production floor employees are using the air plane mill (model and serial numbers unknown due to a missing data plate) in the production of the heads for the engines manufactured without having guarded the fast spinning cutting area.   iii. On the production floor employees are using the Berco RTM-225 crank shaft grinder without having adequate guarding over the fast spinning crank shaft.

This was most recently evident during the inspection of the facility located at 404 West 8th Street, Kearney, NE 68845, where the employer has employees using a General Machine Industrial model 36127 bench grinder to sharpen tools and the tool rest is set at 1/4th of an inch thus creating the potential for the tool to get caught between the rest and the fast spinning abrasive wheel.

This was most recently evident during the inspection of the facility located at 404 West 8th Street, Kearney, NE 68845, where the employer has employees using a General Machine Industrial model 36127 bench grinder to sharpen tools and the tongue guard is missing leaving a gap of ¾ between the abrasive wheel and the frame of the bench grinder.
