OSH ACT of 1970 Section (5)(a)(1):     The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by of falling load hazards:    Frequent and periodic inspections were not performed on two of the 2-Ton CM hoists; two of the 1-Ton Dayton hoists; three of the 2-Ton Dayton hoists; and one 1/2-Ton Dayton hoists.  Employees were exposed to struck-by hazards associated with falling loads and/or an overloaded hoist.    Among other methods, one feasible and acceptable abatement method is:    Perform frequent and periodic inspections as required by ASME B30.16-2007 - OVERHEAD HOISTS, Section 16-2.1.2 and 16-2.1.3.  Inspections include, but are not limited to, controls and operating mechanisms for improper operations; safety devices for malfunction; deterioration or leakage in air systems; and, deformations, chemical damage, or cracks in hook.

29 CFR 1910.134(e)(1):     The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    Paint Booth and Paint Shop area - Employees using the 3M 5301 Grand Dual Cartridge respirators and 3M 6900 Full Face Piece respirators were exposed to inhalation, hygiene illnesses and chemical absorption hazards in that the medical evaluation procedure was not conducted before allowing the employees to wear the respirators.    29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.

Employees engaged in respirator operations without any medical evaluation, fit test, procedures and schedule logs for cleaning, disinfecting, storing, inspecting, repairing, replacing & discarding cartridges, and otherwise maintaining respirators.    29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
