29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer:     a) FEA Industries, Inc. -   The employer provided their employees with half face, negative pressure respirators [e.g. elastomeric and disposable N95 models] prior to establishing a written program with procedures to properly protect their employees' health when they are required to wear respiratory protection. This was observed on February 6, 2013.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:   a) FEA Industries, Inc. -The employer provided their employees with half face,negative pressure respirators [e.g. elastomeric and N95 disposable N95 models]  to be worn when performing assigned job duties by the president/owner of the company without providing medical evaluation prior to wearing the respirators. This was observed on February 6, 2012.

29 CFR 1910.134(f)(2):   The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.      a) FEA Industries, Inc. - The employer provided their employee with a half face, negative pressure respirators [e.g. elastomeric and disposable N95 models] who operate the bead blast machine and those handling the silica based product [e.g. Diatomaceous Earth]  with out an annual fit test. This was observed on February 6, 2013.

29 CFR 1910.1200(e)(1):   The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) FEA Industries, Inc. - A site specific written hazard communication program was not developed and/or implemented by the employer, for their employees who were exposed to hazardous chemicals. Employees were pouring a hazardous silica based powder, Diatomaceous Earth, which was being used in a water filtration process. This was observed on  February 6, 2013.

29 CFR 1904.40(a):   The employer did not provide an authorized government representative copies of  records kept under part 1904 within the four business hours:    a) FEA Industries, Inc. - The OSHA 300 and 300A logs for the calendar years of 2011, 2010 and 2009 were not provided within four (4) hours of the compliance officer's request. This was observed on February 6, 2013
