29 CFR 1910.132(a):     Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    (a) At the worksite located on 177 Tun Juan Rivera Way, Tamuning, GU, on February 7, 2013, an employee was operating a Nissan Industrial truck, number P 102-115082, without the use of seat belts. Seat belts in the forklift truck are a component part of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a tip over accident, a hazard to which forklift trucks are particularly susceptible, and that the failure to wear the seat belt that is provided in the forklift truck increases the risk of injury to the operator in the event of such an accident.

29 CFR 1910.178(l)(6):     Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.    (a) At the work site, on or about February 7, 2013, the employer failed to certify that the employee who was assigned to operate the Nissan Industrial truck, number P 102-115082, was trained and evaluated as required by this paragraph.

29 CFR 1910.178(q)(7):     Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    (a)  At the work site, on or about February 7, 2013, the Nissan Industrial truck, number P 102-115082, was not examined daily prior to being placed in service.  The truck has a defective left tilt cylinder that was not immediately corrected.
