29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    (a) Near the entrance to the outside bathroom on or about February 11, 2013, eye protection was not used when cutting ceramic tile with a 110 VAC DeWalt right angle grinder with a steel blade.  The floor tile was to fit around a corner of door jam.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not be protected by protective helmets:    (a) At ground level on the south side of the building on or about February 11, 2013, head protection was not worn while installing ropes and pulleys to raise structural steel to the second level.  Another employee was on the second level using a hammer and other tools above the employee at ground level about 18.5 feet below.

Wood splice plates were not provided on at least two adjacent sides, and did not extend at least 2 feet (0.6 m) on either side of the splice, overlap the abutted ends equally, and have at least the same cross-sectional areas as the pole. Splice plates of other materials of equivalent strength may be used:    (a) On the second level on or about February 11, 2013, the wood poles were overlapped and nailed together instead of being abutted, end to end with splice plates on a double-pole pole wood scaffold.  The scaffold was about 50 feet long and the top platform was about 15 feet, 2 inches high.  Employees were on the scaffold to build form work.
