29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: (a) Jobsite: On or about February 6, 2013, employees were not protected from falling at least partially through the steel and wood framing as they went to access/egress the 6 foot stepladder. The floor holes had various sizes and shapes.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigied support that will not deflect, and/or a grasping device was not provided to assist emmployees in mounting and dismounting the ladder: (a) Jobsite: On or about February 6, 2013, employees were using a 6 foot stepladder that was to short, was not tied off, nor were there any grasping devices for when the employees went to get on or off of the ladder. The employees used this ladder to access the area of the attic above the judge's chambers. The fall hazard to the employees was about 6 1/2 feet to the wooden floor.
