29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: 1) On February 7, 2013, Westar Framing, Inc., as the controlling employer, did not ensure that employees of its sub-contractor, C&E Construction, were protected from falls at Building 1 in the following instances: a) Where guardrails were not installed on the unprotected edge next to the ladder that employees used to access the second floor. b) Where employees were sitting a wall on the 3rd floor and were not protected by guardrails, safety net systems, or personal fall arrest systems.

29 CFR 1926.501(b)(4): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: 1) On February 7, 2013, Regency Residential Partners, LLC. as the controlling employer, did not ensure that employees of its sub-contractor, CME Construction, were protected from falling through holes at Building 1 in the following instances: a) On the south side of the second floor near the ladder to the third floor. b) On the north side of the third floor.
