On or about February 7, 2013 - at the above addressed jobsite, on the thriteenth floor, the top rail of the guardrail system measuerd 32 inches above the walking/working level, thereby exposing the employees to fall hazrds.

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members shall be installed between the top edge of the guardrail system and the walking/working surface when there is no wall or parapet wall at least 21 inches (53 cm) high. a. On or about February 7, 2013- at the above addressed jobsite, employees were exposed to falls to the exterior of the building due to the lack of mid-rails on the guardrail system. Employees were thereby exposed to the hazards associated with falls.
