29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, and enclosures was not permanent and continuous:    (a) In the maintenance house on or about February 14, 2013, there was no grounding on the outlet that supplied power to a sump pump in the pool.  The sump pump was used to pump water out of the pool.  Employees were in the pool to chip excess concrete off the pool's sides.

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities were not in near proximity to the worksite and were not so equipped as to enable employees to remove such substances:  (a) At the project on or about February 14, 2013, and at times prior thereto, adequate washing facilities were not provided for employees that mixed, poured and applied portland cement for a parking lot and swimming pool  A hose, connected to an exterior spigot, supplied water to wash.  Soap was not provided or available onsite.  Towels or other drying methods were not provided.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    (a) At the bottom of the swimming pool on or about February 14, 2013, instead of wearing shoes with safety toes, employees wore open toed sandals.  Employees carried hammers and other tools to chip concrete off the pool's sides.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder:    (a) At the south end of the swimming pool on or about February 14, 2013, a 4.5 foot long extension ladder did not extend at least three feet above the landing level and was not secured at its top.  There were no devices to grasp onto.  Employees used the ladder to access the pool deck level.  They were in the pool to chip excess concrete off the pool's sides.
