29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) On or about February 13, 2013 and at times prior, two employees were exposed to cave-in hazards while working inside an unprotected excavation, where the competent person who performed the inspection of the excavation did not remove the employees from the excavation until the hazard was corrected. The excavation measured approximately 12 feet deep with its wall showing signs of cracks and fissure. Note: Hoier Excavating LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 477520, Citation 2, Item 1(b) issued July 13, 2102 with respect to a workplace located at 1622 South Academy Blvd., Colorado Springs, CO 80910. This citation became a final order on August 1, 2012.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b)or (c) of this section: (a) On or about February 13, 2013 at times prior, two employees were exposed to cave-in hazards while working inside an excavation without an adequate protective system. The excavation measured approximately 12 feet deep with its wall showing signs of cracks and fissure. Note: Hoier Excavating, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 477520, Citation 2, Item 1(a) issued July 13, 2102 with respect to a workplace located at 1622 South Academy Blvd., Colorado Springs, CO 80910. 29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) On or about February 13, 2013 and at times prior, two employees were exposed to cave-in hazards from the loose soil at and around the edge of the excavation opening. The excavation measured approximately 12 feet deep with its wall showing signs of cracks and fissure. Note: Hoier Excavating, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 477520, Citation 1, Item 2 issued July 13, 2102 with respect to a workplace located at 1622 South Academy Blvd., Colorado Springs, CO 80910. This citation became a final order on August 1, 2012.
