29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    (a)  On or about June 28, 2018, employees were exposed to struck-by hazards created by working inside an unprotected trench without the spoil pile being placed at least two feet away from the edge.    Hoier Excavating, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 887143, Citation Number 1, Item Number 2, and was affirmed as a final order on March 19, 2013, with respect to a workplace located at Powers and Dublin, Colorado Springs, CO.     Hoier Excavating, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 477520, Citation Number 1, Item Number 2, and was affirmed as a final order on August 1, 2012, with respect to a workplace located at 1622 S. Academy Blvd, Colorado Springs, CO.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a)  On or about June 28, 2018, employees were working inside an excavation that was in excess of 5 feet deep with near vertical walls without any protective systems being in place.    Hoier Excavating, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 887143, Citation Number 1, Item Number 1b, and was affirmed as a final order on March 19, 2013, with respect to a workplace located at Powers and Dublin, Colorado Springs, CO.     Hoier Excavating, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 477520, Citation Number 2, Item Number 1a, and was affirmed as a final order on August 1, 2012, with respect to a workplace located at 1622 S. 29 CFR 1926.95(d)(1): The employer did not provide personal protective equipment, at no cost, to the employees:    (a) On or about June 28, 2018, and at times prior, Hoier Excavating, LLC required employees upon hiring to provide their own hard hats, reflectorized vests and work gloves before they were allowed onto the jobsite.
