Construction Reference: 1926.59  NOTE: The requirements applicable to construction work under this section are identical to those set forth at § 1910.1200 of this chapter.     29 CFR 1910.1200(h)(1):  Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a) On or about 14 February 2013, the employer did not provide the employee(s) with effective information and training regarding the health hazards of workplace chemicals.   Employee(s) were exposed to airborne particulate matter containing crystalline silica (up to 10%) while dry cutting sidewalk concrete to create an opening for the purposes of locating the water service pipes.

29 CFR 1926.102(a)(1):  Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    a)  On or about 14 February 2013, the employer did not ensure that employee(s) engaged in dry cutting sidewalk concrete (containing up to 10% crystalline silica)  used eye protection (safety glasses) to protect them against flying particles.  Worker(s) were creating an opening in order to locate the water service pipes and disconnect the water service to a demolished building.  Employee(s) were exposed to dust plumes generated during dry cutting of concrete using a STIHL TS420 saw and none of the workers wore safety glasses.
