29 CFR 1917.45(b)(1): Cranes and derricks having ratings that vary with boom length, radius (outreach), or other variables did not have a durable rating chart visible to the operator, covering the complete range of the manufacturer's capacity (or design) ratings: (a) Dock, Crane #1: On or about February 6, 2013 and at times prior thereto, the Slattery Model Number MCK 1250, Serial Number MCK 242094 pedestal crane was not equipped with a rating chart. This condition exposed employees to a struck-by hazard in the event the crane was operated outside of its prescribed limits. (b) Dock, Crane #2: On or about February 6, 2013 and at times prior thereto, the Marine Crane Model Number TB 16-50, Serial Number 1318 pedestal crane was not equipped with a rating chart. This condition exposed employees to a struck-by hazard in the event the crane was operated outside of its prescribed limits. (c) Dock, Crane #3: On or about February 6, 2013 and at times prior thereto, the Aurora Model Number 40 KNG 3000, Serial Number 91189-11791 pedestal crane was not equipped with a rating chart. This condition exposed employees to a struck-by hazard in the event the crane was operated outside of its prescribed limits.

29 CFR 1917.45(k)(3): Defects found during inspection of cranes or derricks that created a safety hazard were not corrected by a designated person before further use of the equipment: (a) Dock, Crane #3: On or about February 6, 2013 and at times prior thereto, the seat on the Aurora Model Number 40 KNG 3000, Serial Number 91189-11791 pedestal crane was not attached to its base. This condition affected the employee's ability to operate the crane safely and exposed employees to a struck-by hazard in the event the seat released during crane operations.
