29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: (a) Inside the building with the chiller on or about February 20, 2013, there was no assured equipment grounding conductor program or ground-fault circuit-interrupters to protect employees that used a 110 VAC Makita drill to drill out rivets on an elbow to the chiller. The drill was powered through an extension cord that was plugged into an outlet in the building.
