29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii): On or about February 25, 2013, employee was exposed to a fall of approximately 15 feet in elevation to the ground level below from a two tiered tubular welded scaffold which had approximately 2 plankings while employee was plastering the walls of a residential home.

29 CFR 1926.451(b)(5)(ii): Each platform greater than 10 feet in length shall not extend over its support more than 18 inches (46 cm), unless it is designed and installed so that the cantilevered portion of the platform is able to support employees without tipping, or has guardrails which block employee access to the cantilevered end: On or about February 25, 2013, employee was exposed to a fall of approximately 8 feet in elevation to the ground level below from a two tier scaffold while employee was climbing down from the first tier of the cross bracing and stepping on to a plank below, that extended approximately three feet beyond its support.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access: a) North side: On or about February 25, 2013, employee was exposed to a fall of approximately 15 feet in elevation to the ground level below from a two tier scaffold while employee was climbing from the first tier at approximately 8 feet to the second tier of the scaffold. b) Northeast side: On or about February 25, 2013, employee was exposed to a fall of approximately 8 feet in elevation to the ground level below from a two tier scaffold while employee was climbing down from the first tier. THE WATERLOO PLASTERING INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATION SAFETY AND HEALTH STANDARD, ITS EQUIVALENT, OR ESSENTIALLY SIMILAR STANDARD, 29 CFR 1926.451(e)(1), WHICH WAS CONTAINED IN OSHA INSPECTION 312853963, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 2, 2010, WITH RESPECT TO WORKPLACE LOCATED AT 1338 SOUTH MAIN ST. , BOERNE, TX 78006. THE WATERLOO PLASTERING INC.
