29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a)Crow Creek Construction, LLC @ WCR 43 & Hwy 14, Ault, CO 80601: On and before February 23rd, 2013, the exposing employer did not ensure a safe means of access and egress was provided while working within an excavation. The means of access and egress was by walking up the north face of the excavation which exposed employees to cave-in hazards. This condition exposed employees to the hazard of trench cave in while accessing and egressing the excavation employees had to enter to install a boot on a water line.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraphs (b) or (c) of this section: (a) Crow Creek Construction, LLC @ WCR #43 & Hwy 14, Ault, CO 80610: On and before February 23rd, 2013, the exposing employer did not ensure that each employee conducting work in the excavation was protected from cave-in, in that the excavation was approximately 10 feet deep on the east wall and approximately 8 feet deep on the south and west wall and lacked a cave-in protective system, such as appropriate sloping, benching, or shielding systems. This condition exposed two employees while installing a boot on a water line to a crushing hazard by excavation wall cave-in.
