29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) On or about October 3, 2024, employees were exposed to fall hazards of approximately 13 feet, into an unguarded portion of a trench, while taking surveying measurements from the top of a capped concrete cylinder without fall protection.

29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face: (a) On or about October 3, 2024, the employer did not ensure employees installing an eight inch sewer main, in a 23.5 ft. deep excavation, were protected from hazards posed by loose rock or soil falling from the face of the excavation, in that the boxes top edge was not of adequate height above grade, nor was equipped with endcaps, which would prevent materials from falling or rolling into the excavation. This condition exposed employees to cave-in hazards.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of the support system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the support system: (a) On or about October 3, 2024, the employer did not ensure the excavation of martials to be no greater than 2 feet below the bottom of the members of the support system, in that soil was removed approximately 5 feet below the bottom of the GME trench shield, model number 6M820, serial number N0202256-2SP. This condition exposed employees to cave-in hazards.
