29 CFR 1926.1437(c)(2):  The employer did not:  Erect and maintain control lines, warning lines, railings or similar barriers to mark the boundaries of the hazard areas; or Clearly mark the hazard areas by a combination of warning signs (such as, "Danger-Swing/Crush Zone") and high visibility markings on the equipment that identify the hazard areas.  In addition, the employer must train each employee to understand what these markings signify.    a)  Colony Road at the Greenville Rail Yard, Jersey City, NJ.    Employees working on the spud barge in the vicinity of the Link-Belt crane were in danger of struck-by injuries as the employer had not provided for the crane's Swing/Crush Zone to be guarded as specified in the regulation.                                                              Violation observed on or about 02/04/2013.

The spud barge which was the means of floatation for the Link-Belt crane did not have a list and trim device located in the cab or at the operator's station exposing workers to injury from crane instability.                                                     Violation observed on or about 02/04/2013.

29 CFR 1926.1437(n)(1):  For land cranes/derricks used on barges, pontoons, vessels or other means of flotation, the employer did not ensure that the rated capacity of the equipment (including but not limited to modification of load charts) applicable for use on land is reduced to:  account for increased loading from list, trim, wave action, and wind; be applicable to a specified location(s) on the specific barge, pontoons, vessel or other means of flotation that will be used, under the environmental conditions expected and encountered; and the conditions required in paragraphs (n)(3) and (n)(4) of this section are met.    a)  Colony Road at the Greenville Rail Yard, Jersey City, NJ.    The employer did not provide for the Link-Belt hydrualic lattice boom crawler land crane to have load charts modified for lifting on water. The employer did not ensure the Link-Belt hydraulic lattice boom crawler crane was physically attached to the barge nor were other options of this standard in use to protect employees from the danger of the crane toppling into the water.
