OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm including injuries from struck-by and crushed-by hazards: Site: Lincoln Tunnel 188, Weehawken, NJ 07086. a). On or about August 14, 2025, Railroad Construction Co., Inc. employees who were working on scissor lifts in the center tube of the Lincoln Tunnel were exposed to being struck by passing construction vehicles. The employer did not install traffic channeling devices or have specific means in place to control traffic while the JLG 1930ES scissor lift was positioned in the center tube of the tunnel and struck by a dumpster truck Ford F5550.
