29 CFR 1910.212(a)(1): 29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees in the machine area from having any part of their body in the danger zone(s) from hazards created by point of operation, rotating parts, flying chips and sparks during operating cycle(s):    (a) Magna Energy Services, LLC @ 0902 Road 4, Wiggins, CO. On or before February 12, 2013, the employer did not ensure that proper guarding was provided to protect machinists and other employees from hazards created by the rotating unguarded chuck for each of the lathes used by employees in the shop. This condition exposed employees to a strike-by and/or amputation hazard.    (b) Magna Energy Services, LLC @ 0902 Road 4, Wiggins, CO. On or before February 12, 2013, the employer did not ensure that proper guarding was provided to protect machinists and other employees from hazards created by unguarded point-of- operation on each Index milling machines used by employees in the shop. This condition exposed employees to a strike-by and/or amputation hazard.    (c) Magna Energy Services, LLC @ 0902 Road 4, Wiggins, CO. On or before February 12, 2013 the employer did not ensure that the DoAll Horizontal Metal Band Saw used by employees in the shop was equipped with adequate point-of-operation blade guarding. The unused portion of the front the blade was not guarded to protect employees against amputation hazards during the operating cycles.    (d) Magna Energy Services, LLC @ 0902 Road 4, Wiggins, CO. On or before February 12, 2013 the employer did not ensure that the Horizontal Metal Hack Saw used by employees in the shop was equipped with adequate point-of-operation blade guarding. The unused portion of the front the blade was not guarded to protect employees against amputation hazards during the operating cycles.

On or before February 12, 2013 the employer did not ensure that the free standing Dayton abrasive grinder used by employees in the shop was securely anchored to the floor to prevent from tipping over or moving. On or before February 12, 2013 the employer did not ensure that the Dayton abrasive grinder(s) used in the shop by employees was equipped with an adjustable tool work rest for safely grinding operation and to compensate for any wheel wear by maintaining it adjusted closely to the wheel with a maximum opening of an 1/8 inch to prevent the work from being jammed. This condition exposed employees to the hazard of flying projectiles in an event of grinding wheel breakage during operating cycles.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l):    (a)Magna Energy Services, LLC @ 0902 Road 4, Wiggins, CO. On or before February 12, 2013, the employer did ensure that each employee who operated the forklift at the facility was provided with operator training as required under the standard. This condition exposed employees to the hazard of unsafe operation to serious injury or death from lack of appropriate forklift training.    Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. All operator training and evaluations shall be certified and conducted by a person who has knowledge, training and experience to train and evaluate the operator's competence in the workplace.
