29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents. On or about February 27,2013, on the roof, the employer did not ensure employees using pneumatic nail guns were protected by the use of protective eyewear. The employees actively used the pneumatic nail guns on the day of this inspection while installing roof shingles on each apartment building. This condition exposed the employees to serious eye injuries.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, personal fall arrest system or an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about , February 27, 2013, the employer did not ensure that each employee working and walking on a steep roof, with unprotected sides and edges were protected from falling approximately 30 feet by a fall protection system. The roof pitch measures approximately 6:12. Alternative fall protection system use not attempted. Employee was exposed to fall hazards while performing roofing activities assigned by the employer.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about February 27, 2013, the employer did not ensure the aluminum extension ladder extended three feet above the roof landing. The employees used the ladder to access the roof while performing roofing activities of a 3 story, multi-family structure. This condition exposed the employees to the hazard of stumbling and falling from the ladder approximately 30 feet to the ground below.
